¡°One Belt and One Road¡± Legal Practice and Service Innovation Forum ---the 6th China Corporate Legal Affairs Annual Conference (South China) Held in Shenzhen

The Conference was jointly chaired by Ms. Li Xiaoguang, Secretary-General of CIETAC/CMAC South Sub-Commission and Ms. Xiao Jingyi, Executive Director of Shenzhen Benchmark Chambers International. Mr. Shao Bingfang, President and Party Secretary of Legal Daily delivered the opening speech.

Leaders of the judicial system attended the meeting, including Mr. Du Mao, Chairman of China Legal Service (HK) Limited, Mr. Zeng Xianglu, Director-General of Guangdong Justice Bureau, Mr. Du Chun, Chairman of Legal Professional Committee, Hong Kong Chinese Enterprises Association, Mr. Sun Jianying, General Manager of China Legal Service (Macau) Limited, Mr. Dong Shi, Deputy Director of Hong Kong, Macao and Taiwan Legal Training and Communication Center of Ministry of Justice P.R.C., Mr. Jiang Xilin, Director of Shenzhen Judicial Bureau, Mr. Jiang Xiaowen, Director of Shenzhen Legislative Affairs Office, Mr. Yu Xuejie, Deputy Director of Law Department in Liaison Office of the Central People¡¯s Government in the HKSAR, Judge Xi Xiangyang of the first patrol court of the Supreme People's Court, Mr. Zhao Jian, Vice President of CIETAC Arbitration Court, Mr. Xiao Shengfang, Chairman of Guangdong Lawyers Association, Mr. Lin Changchi, Chairman of Shenzhen Lawyers Association, Mr. Cao Hailei, Director of Qianhai Administrative Office, etc. The Conference also attracted over 300 general counsels and senior managers from large enterprises, judicial administrative officers, judges, lawyers and legal experts and scholars from both mainland and Hong Kong alike.


 

The Conference was held shortly after the success of ¡°One Belt and One Road¡± International Summit. With the accelerated development of foreign-related legal services industry, focusing on ¡°¡¯One Belt and One Road¡¯ Legal Practice and Service Innovation,¡± this Conference set up three sub-themes: ¡°¡¯One belt and One Road¡¯ Legal Practices and Risk Countermeasures,¡± ¡°Commentary on Compliance System Construction for Chinese Enterprises¡® Global Schemes,¡± and ¡°Sharing on ¡®One Belt and One Road¡¯ Related Dispute Resolution Practice and Service Innovation.¡±

Judge Xi Xiangyang of the first patrol court of the Supreme People's Court, Mr. Tang Gongyuan, Senior Partner of JunZeJun Law offices, and Professor Li Yuwen of Eramus School of Law, Erasmus University Rotterdam separately gave the keynote speeches on serving and ensuring the judicial measures for construction of the Belt and Road Initiative, top designation and system innovation of ¡°One Belt and One Road¡± related dispute resolution mechanisms, and the latest trends of settling disputes among investors and countries in the European Union.


 

Ms. Feng Baozhen, General Manager of LexisNexis China, and Mr. Zhao Hexuan, Senior Associate of Fangda Partners respectively interpreted the "2016-2017 Research Report of Chinese Enterprises¡¯ Global Outreaches" and "2016-2017 Research Report on Chinese Enterprises¡¯ Anti-Corruption and Compliance Practices.¡±

Mr. Du Chun, Chairman of Legal Professional Committee, Hong Kong Chinese Enterprises Association, Mr. Jiang Xilin, Director of Shenzhen Judicial Bureau, Mr. Zhao Jian, Deputy Secretary-General of CIETAC, Mr. Zhang Hua, General Counsel of Air China Group Company, Mr. Zhou Litao, General Counsel of China Coal Group, Guo Junxiu, General Counsel of China Eastern Airlines Group Company, and Liu Kejiang, lawyer of Dhh Law Firm shared and exchanged their views on ¡°One Belt and One Road¡± related legal practices and risk countermeasures. The Panel was chaired by Professor Zhang Xiaojun, Dean of International Law School of Southwest University of Political Science and Law.

Professor Yang Li, Vice Dean of KoGuan Law School, Shanghai Jiao Tong University, chaired the Panel discussing ¡°Compliance System Construction for Chinese Enterprises Seeking to Go Global.¡± Mr. Zhao Hexuan, Senior Associate of Fangda Partners, Mr. Li Jiang, Deputy General Manager of Legal and Financial Services at LexisNexis China, Mr. Wang Chunge, General Counsel of China Merchants Group, Ms. Xu Qian, General Counsel of BGI, Ms. Pang Melissa Kaye, Deputy Chairman of Hong Kong Lawyer Association all delivered speeches.

Moderated by Mr. Han Kaichuang, Vice Chairman and Director of Compliance of JZ Securities, Mr. William Wong Ming-fung, Vice Chairman of Hong Kong Bar Association¡¯s Special Committee on China Practice Development, Mr. Xi Xiaohong, Chairman of IXLN Holdings Company Limited, Mr. Xie Chenyang, Vice President and General Counsel of Tiens Group, Mr. Zhang Jian, Deputy Director of Huawei Technologies¡¯ Legal Department, Ms. Xie Changqing, Director of Business Development Division of CMAC and Secretary-General of CMAC Tianjin Sub-Commission, Mr. Zhang Lazhu, former Director of Legal Department of CCECC, Mr. Zhou Qinghua, General Manager of Legal Department of Zhonghai Group, Mr. Feng Mingjie, General Manager of Compliance Department of Tecent Finance, and Mr. Lin Changchi, Chairman of Shenzhen Lawyers Association shared their views and experiences concerning the related practices.

Representing the organizers, Vice President of CIETAC Arbitration Court Mr. Zhao Jian delivered a speech named ¡°Belt and Road Initiative and Innovation and Development of China¡¯s Arbitral System.¡± Zhao pointed out that the Belt and Road Initiative in China brought opportunities and challenges to the development of our country¡¯s arbitral system; therefore, we should spare no effort to improve the capability of our arbitration industry to serve the Belt and Road Initiative, to render strong support towards the relevant arbitration institutions to carry out international investment arbitrations, to deepen the cooperation of arbitration affairs among countries along the land and maritime Silk Roads, and to build the new ¡°One Belt and One Road¡± dispute settlement mechanism.


Ms. Xie Changqing, Director of the Business Development Division of CMAC and the Secretary-General of CMAC Tianjin Sub-Commission, shared the experience of setting up terms and provisions of foreign-related dispute resolution through a telling example of a top-level foreign-related maritime case.


 

As representatives of corporate counsels and CIETAC arbitrators, Mr. Guo Junxiu, General Counsel of China Eastern Airlines Group, shared the rich experiences of China Eastern Airlines in risk prevention; Mr. Wang Chunge, General Counsel of China Merchants Group, taking the development project of Zhongbai Industrial Park as an example, also shared his valuable experience in construction of enterprise compliance system from the perspectives of framework construction, local traditional culture reservation, and active participation in domestic construction.

The one-day conference came to an end with participants, while enjoying the chance to thoroughly exchange their ideas and experiences, still yearning for more. It is indeed an event combining expertise in both legal theories and practices, welcomed by both corporate counsels and lawyers, addressing both arbitration and litigation, and full of intellectual confrontations and professional fulfillments.
